1.Who we are and what this policy covers

nGenius Pros LLC operates under the public brand nGenius Pro. This policy applies to nGenius Pro websites, applications, forms, and services that link to this policy. Our mailing address is 1603 Capitol Ave, Ste 413, Cheyenne, WY 82001.

A client agreement, data-processing agreement, business associate agreement, or other written agreement may impose additional requirements for a particular service.

2.Important healthcare and PHI boundary

General nGenius Pro websites, forms, chat widgets, and marketing intake systems are not intended for medical records, diagnoses, treatment information, protected health information, or emergency communications unless a separately approved compliant system has been implemented.

Do not submit patient records, clinical details, or emergency requests through general marketing forms or chat. Healthcare clients are responsible for directing patients to appropriate clinical and emergency channels.

3.Information we collect

  • Name, email address, phone number, and other contact information.
  • Business or practice information, such as business name, location, website, service interests, project needs, and authorized account details.
  • Information included in form submissions, intake forms, calendar bookings, chat conversations, onboarding materials, and support requests.
  • Communications history from email, SMS, calls, chat, meetings, and other service interactions.
  • Consent and opt-in records, including the disclosure presented, source, date, time, and opt-out status when available.
  • Website, device, and analytics data, such as IP address, browser, device type, referring page, pages viewed, approximate location, cookies, and analytics events.
  • Transaction and billing records. Payment processors handle payment-card information under their own terms; we do not intentionally store full payment-card numbers on our website servers.

4.How we collect information

  • Website and marketing forms, intake forms, calendars, chat, email, SMS, calls, and client onboarding.
  • Connected platforms and accounts you authorize us to access or manage, including CRM, analytics, social, Google Business Profile, domain, hosting, and payment systems.
  • Cookies, analytics technologies, server logs, and similar tools used to operate, secure, and understand our websites and services.
  • Referrals, service providers, and public business sources where collection and use are permitted by law.

5.How we use information

  • Respond to inquiries, prepare recommendations or proposals, and schedule consultations.
  • Provide, administer, personalize, and support contracted services.
  • Operate CRM, lead-management, client-onboarding, reporting, and customer-support processes.
  • Send transactional, service, account, marketing, email, SMS, or calling communications when authorized and permitted by law.
  • Maintain consent, opt-out, billing, project, approval, and communications records.
  • Protect accounts, prevent fraud or abuse, troubleshoot systems, and maintain service security.
  • Comply with legal, regulatory, contractual, tax, accounting, and platform requirements.
  • Analyze and improve our websites, services, content, and operations.

6.Service providers and subprocessors

We may disclose information to vendors that perform services for us or our clients. They receive information reasonably necessary for their role and are subject to their own terms and applicable contractual obligations. These providers may include:

  • HighLevel and connected CRM, form, calendar, automation, communications, and account-management services.
  • Website hosting, domain, infrastructure, storage, security, and technical-support providers.
  • Email, SMS, calling, telephony, and communications providers.
  • Analytics, reporting, fraud-prevention, and performance-monitoring providers.
  • Payment processors, invoicing systems, and accounting providers.
  • Social platforms, Google Business Profile, publishing, public-relations, and distribution platforms when required for contracted services.
  • Professional advisers, authorities, or other vendors required to perform contracted services or meet legal obligations.

7.No sale of personal information

We do not sell personal information. We do not sell mobile information or SMS opt-in data, and we do not share SMS consent with third parties for their independent marketing.

We may disclose information to service providers, at your direction, in connection with a business transaction, or when legally required.

8.Cookies and analytics

We and our providers may use cookies and similar technologies for website functionality, security, analytics, attribution, and service improvement. Browser controls may allow you to block or delete cookies, although some functions may not work correctly afterward.

Where applicable law requires consent or an opt-out for particular technologies, we will provide the relevant controls or honor legally recognized requests as required.

9.Email, SMS, and calling choices

Marketing emails include an unsubscribe method where required. We may still send essential transactional or service messages concerning an active request, account, or engagement.

When you expressly consent to SMS, message frequency may vary and message and data rates may apply. Reply STOP to opt out and HELP for help. Consent is not a condition of purchase where applicable. Carriers are not liable for delayed or undelivered messages.

Submitting a general website form does not automatically establish consent for every marketing text or automated call. The disclosure and consent mechanism presented for the specific form and communication purpose controls.

10.Data retention and security

We retain information for as long as reasonably necessary to provide services, maintain business and consent records, resolve disputes, enforce agreements, and meet legal, tax, accounting, security, and compliance obligations. Retention periods vary by record and service.

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. No transmission or storage system is completely secure, so we cannot guarantee absolute security.

11.Client and customer responsibilities

Clients are responsible for providing accurate information, obtaining necessary permissions and consents, maintaining lawful contact lists, honoring opt-outs, and using connected platforms in compliance with applicable laws and platform policies.

Clients must not direct nGenius Pro to upload, process, or transmit regulated or sensitive information through a system that has not been separately approved for that purpose.

12.Children's privacy

Our general business services are not directed to children under 13, and we do not knowingly collect personal information directly from children through these services. Contact us if you believe a child has submitted information improperly.

13.California and other state privacy rights

Residents of California and other states may have rights to request access, correction, deletion, or portability of personal information, and to obtain information about certain disclosures. Rights and exceptions depend on the law that applies and our relationship with you.

We will not unlawfully discriminate against you for exercising an applicable privacy right. We may verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law and subject to verification.

14.Changes to this policy

We may update this policy as our services, vendors, or legal obligations change. The last-updated date identifies the current version. Material changes may also be communicated through the service or directly to active clients where appropriate.
